Waste Collection Hammersmith Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Hammersmith provides waste and rubbish removal services to customers within its service area. By making a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any waste collection service.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings given below:
Customer means any individual, business, organisation, landlord, tenant or other party who requests or uses our waste collection services.
Services means any waste collection, rubbish removal, recycling, clearance, loading, transporting, or related services provided by us.
Waste means any items, materials, rubbish or debris presented by the Customer for collection, including but not limited to household waste, commercial waste, garden waste, bulky items and recyclable materials, subject always to applicable waste regulations.
Contract means the legally binding agreement between the Customer and Waste Collection Hammersmith for the provision of Services, incorporating these Terms and Conditions and any written or verbal confirmation of a booking.
2. Scope of Services
We provide pre-booked waste collection services within our defined service area. The precise services available, including collection types, volumes, and pricing, will be explained to you at the time of booking.
Our Services may include one-off clearances, regular scheduled collections, bulky waste removals, garden waste collection, and recycling, subject to site access and compliance with waste regulations.
We reserve the right to refuse any Waste we reasonably believe to be hazardous, prohibited, or not accurately described at the time of booking.
3. Booking Process
3.1 Placing a booking
Bookings for waste collection may be made by telephone or other communication channels we make available. When you place a booking you will be asked to provide details including your name, address, contact details, type and approximate volume of Waste, access information, and any special requirements.
3.2 Confirmation of booking
The Contract between you and us is formed when we confirm acceptance of your booking, which may be given verbally or in writing. We may issue a booking confirmation setting out the agreed date, time window, and approximate price based on the information you have provided.
3.3 Accuracy of information
You are responsible for ensuring that all information you provide is complete and accurate. Our price, collection time and our ability to perform the Services are based on the information you supply. If the Waste type, volume, access or circumstances differ significantly from your description, we reserve the right to adjust the price, amend the Services, or decline to complete the collection.
3.4 Access and attendance
You must ensure that our team has safe, unobstructed access to the collection location at the agreed time. If you are not present, you must ensure clear instructions are provided and that we have permission to enter any relevant areas. If we are unable to carry out the collection due to lack of access or unsafe conditions, this may be treated as a late cancellation and a charge may apply.
4. Pricing and Quotations
Prices are generally based on the volume and type of Waste collected, the labour required, and any additional services agreed. Any price indication given before the collection is an estimate only, based on the information provided by you.
The final price will be confirmed once our team has inspected the Waste and assessed the work on arrival. If you choose not to proceed after we have arrived and assessed the job, we may charge a call-out or attendance fee to cover our costs.
All prices are stated in pounds sterling and, where applicable, will be subject to VAT at the prevailing rate, unless expressly stated otherwise.
5. Payments
5.1 Payment methods
Payment is due on or before completion of the collection, unless we have agreed credit terms in writing. We may accept cash, card payments, bank transfer, or other methods we notify to you.
5.2 Payment terms for account customers
Where credit facilities are agreed for business customers, invoices must be paid within the period stated on the invoice, usually within 14 or 30 days of the invoice date, unless otherwise agreed in writing. We reserve the right to withdraw credit at any time.
5.3 Late payment
If you fail to make payment by the due date, we may charge interest on the overdue amount at the statutory rate permitted under UK law and may recover reasonable costs incurred in pursuing the debt. We may suspend further services until all outstanding amounts have been paid in full.
6. Cancellations, Rescheduling and Failed Collections
6.1 Customer cancellations
You may cancel or reschedule your booking by contacting us. Where you cancel with reasonable notice before the agreed collection date, no cancellation fee will normally be charged. We will confirm any specific notice periods for cancellation at the time of booking.
6.2 Late cancellations
If you cancel at short notice, including on the day of collection or after our team has been dispatched, we reserve the right to charge a reasonable cancellation fee or attendance charge to cover our administrative and travel costs.
6.3 Failed collections
If we attend the collection address at the agreed time but are unable to complete the job due to circumstances beyond our control, such as lack of access, unsafe working conditions, or incorrect information provided by you, we may treat this as a failed collection and apply a call-out or cancellation fee.
6.4 Our right to cancel or amend
We may cancel or reschedule a booking where we are unable to provide the Services due to events outside our reasonable control, including adverse weather, vehicle breakdowns, staff illness or safety concerns. We will notify you as soon as reasonably practicable and, where possible, arrange a new collection time. We are not liable for any loss you may suffer as a result of such cancellation, but any advance payments for Services not provided will be refunded or credited.
7. Customer Obligations
You agree to:
Provide accurate information about the Waste, including any items that may be hazardous, restricted or require special handling.
Ensure that the Waste is reasonably accessible and suitably presented for collection, and that access routes are clear and safe.
Comply with all applicable laws and regulations, and not to ask us to collect or transport any Waste in breach of those requirements.
Obtain any consents or permissions needed from property owners, occupiers or managing agents to allow us to access the site and remove the Waste.
Indemnify us against any loss, damage, or claim arising from your failure to comply with these obligations.
8. Waste Regulations and Prohibited Items
8.1 Compliance with UK waste law
We operate in accordance with applicable UK waste management legislation and regulations. Waste is transported only to licensed and approved facilities for recycling, recovery or disposal, as appropriate. We maintain duty of care records as required by law.
8.2 Prohibited and restricted waste
Certain materials cannot be collected or require special arrangements. These may include, but are not limited to, asbestos, clinical and medical waste, chemicals, solvents, oils, pressurised containers, gas bottles, explosives, radioactive materials and some electrical items. If in doubt, you must check with us in advance.
We reserve the right to refuse any Waste that we reasonably believe to be hazardous, unlawful to handle or dispose of, or not properly described at the time of booking.
8.3 Misdescription of waste
If hazardous or prohibited items are discovered within a load that has been presented as non-hazardous, we may charge additional fees for safe handling, storage, or disposal, and may return such items to you. You will be responsible for any fines, penalties or claims arising from misdescribed Waste you present for collection.
9. Liability and Insurance
9.1 Our responsibility for loss or damage
We will exercise reasonable skill and care in providing the Services. However, we are not liable for:
Any pre-existing damage to property, fixtures, fittings or surfaces.
Damage arising from inadequate or unsafe access routes or from the inherent nature of the premises.
Indirect or consequential loss, including loss of profits, loss of business or loss of opportunity.
Our total liability for any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total fees paid or payable by you for the specific collection giving rise to the claim, unless otherwise required by law.
9.2 Liability for personal items
You must ensure that no personal belongings, valuables or items you wish to keep are left in or among the Waste presented for collection. We are not responsible for any such items once removed with the Waste.
9.3 Liability not excluded
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any matter for which it would be unlawful to exclude or limit liability under UK law.
10. Health and Safety
We are committed to operating safely and to protecting our staff, customers and the public. Our team may refuse to carry out any work they consider unsafe, including where access is hazardous, the Waste is unstable or presents health and safety risks, or the working environment is otherwise unsuitable.
You agree to take reasonable steps to ensure that the collection area is safe, to keep pets and children away from operational areas, and to follow any safety instructions given by our staff.
11. Data Protection and Privacy
We collect and process personal information such as your name, contact details, and service history in order to provide our Services, manage bookings, process payments and comply with legal obligations.
Your information will be handled in accordance with applicable UK data protection laws. We will not sell your personal data to third parties. We may share limited information with service providers who assist us in delivering our Services, such as payment processors, on a strict need-to-know basis.
12. Complaints and Dispute Resolution
If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible with details of your concern. We will investigate the matter and aim to respond within a reasonable timescale.
Where a dispute cannot be resolved informally, either party may pursue its rights through the UK courts as set out in the governing law and jurisdiction clause below.
13. Variation of Terms
We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that Contract. Any significant changes will be made available on request. Continued use of our Services after changes take effect constitutes your acceptance of the revised Terms and Conditions.
14. Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed deleted, but the remaining provisions will continue in full force and effect.
15. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
16. Entire Agreement
These Terms and Conditions, together with any booking confirmation or other written agreement between us, constitute the entire agreement between you and Waste Collection Hammersmith in relation to the Services. You confirm that you have not relied on any statement, promise or representation that is not set out in these documents.
By placing a booking and using our waste collection services, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
